Aperture Automations provides managed AI automation, including the Jericho AI voice agent and related messaging, email, and scheduling automation. Our website is informational; demos are scheduled through a third-party booking tool. Any paid engagement is provided under a separate written agreement or statement of work (“Service Agreement”), which controls if it conflicts with these Terms.

2.Eligibility

You must be at least 18 years old and, if acting for a business, authorized to bind that business to these Terms.

3.Use of the website

You agree to use the website lawfully and not to interfere with its operation, attempt unauthorized access, or use it to transmit harmful or unlawful content.

4.Client responsibilities and consent

If we deploy an AI agent for your business, you are responsible for ensuring you have the legal right and any required consent to contact, call, text, email, or record the individuals the agent interacts with. This includes obligations under laws such as the TCPA (automated calls and texts) and state call-recording laws (including California’s all-party consent requirement). We will configure the agent to support compliant practices, such as recording notices, but you remain responsible for your own legal compliance.

5.Intellectual property

The website, our software, configurations, and brand are owned by Aperture Automations. You retain ownership of your own business data and content. Under a Service Agreement, we grant you the right to use the agent we deploy for you; that right ends if the engagement ends.

6.Third-party services

Our services rely on third-party platforms (for example, voice, language model, messaging, calendar, and CRM providers). Your use of the services may be subject to those providers’ terms, and we are not responsible for their availability or actions.

7.AI-generated output

AI agents generate responses automatically and may occasionally be inaccurate, incomplete, or unexpected. Our agents are tools to assist your business and are not a substitute for professional, legal, medical, or financial advice. You are responsible for reviewing and supervising how the agent is used in your operations.

8.Disclaimers

The website and services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or secure.

9.Limitation of liability

To the maximum extent permitted by law, Aperture Automations will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability arising out of or relating to the services will not exceed the amount you paid us in the three months before the event giving rise to the claim.

10.Indemnification

You agree to indemnify and hold harmless Aperture Automations from claims arising out of your use of the services, your data, or your breach of these Terms or applicable law — including claims related to contacting or recording individuals without required consent.

11.Termination

We may suspend or end access to the website or services if these Terms or a Service Agreement are violated. Provisions that by their nature should survive termination — such as intellectual property, disclaimers, limitation of liability, and indemnification — will survive.

12.Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Fresno County, California, unless a Service Agreement specifies otherwise.

13.Changes to these Terms

We may update these Terms from time to time. Continued use of the website or services after an update means you accept the revised Terms. We will revise the “Effective date” above when we make changes.
